The learned APP Mr. Gavand has produced the Roznama of Special Case No. 11 of 2014 and, according to him, the applicant is responsible for the delay in trial, as on account of pendency of the present bail application, he is restraining the Special Court from proceeding with the evidence of the victim and it is informed that her evidence is partly recorded. 2.

It is made clear that the applicant shall not protract the trial on the ground that the bail application is pending before this court and if such a request is made the Special Court shall reject the said request.

The applicant is incarcerated since 2019 as despite the CR Ashish Mhaske

2/2 61 BA 3676.21.doc came to be registered in 2013, on being released on bail, he has absconded and was again required to be remanded in judicial custody.

Considering that the trial is pending since 2014, the Special Court is requested to conclude the trial in Special Case No. 11 of 2014 within a period of 6 months from today. If the trial is not completed, the applicant is at liberty to renew his request.

Application rejected.
