Learned counsel for the Respondent points out that Applicant No.1, by way of this application seeks to transfer the Divorce Petition No.386 of 2013 filed in the Family Court at Surat, to the Family Court at Thane.

As rightly contended by the learned counsel for the Respondent, the High Court will not have power to transfer the proceedings from one State to another under Section 24 of the Code of Civil Procedure and the Applicant will have to seek her remedies elsewhere. Learned counsel for the Applicants submitted that the matter may be referred for the mediation. It is pointed out
