1) This is the third application for anticipatory bail filed by the applicants. The first Anticipatory Bail Application No.1348/2016 has been dismissed by this Court by a reasoned order dated 29/8/2016. The applicants thereafter immediately preferred 2nd Anticipatory Bail Application No. 1529/2016. which has been dismissed by this Court on 31/8/2016 by deprecating the practice adopted by the learned counsel for the applicants.
2) The present application was called out for hearing in the morning session and it was pointed out to the learned Advocate for the applicants that the practice which was being adopted by the applicants and or their advocate has already been deprecated by its Order dated 31/8/2016. This Court also expressed anguish about the practice adopted by the learned Advocate for the applicants and had
2 /2 4-aba-1606-16.doc cautioned him of taking stringent action against him as may be permissible under the law.
3) The learned Advocate appearing for the applicants profusely pleaded before this Court for leniency and prayed that no stringent action as may be contemplated under the law be taken against him. He had submitted that he will file an affidavit-cum-undertaking before this Court for showing leniency to him. The matter was, therefore, kept back and is now called in the second session for hearing. The learned advocate-on-record has filed the affidavit dated 19/9/2016. The same is taken on record and marked "X" for identification. In view of the statements and undertaking given in the said affidavit, the same is accepted.
4) The present application being dehorse of any merits and as there is no change in circumstances least any substantive change in circumstance, is dismissed in limine. (A.S.GADKARI, J.)
