Heard learned counsel for the applicant and the learned APP for the State. The applicant face accusations in the subject C.R. which invokes sections 370 (2), 370 (3) r/w section 34 of IPC, and section 4 and 5 of Prevention of Immoral Traffic Act, 1954. The subject CR arraigned 4 persons as accused and the applicant seek protection from arrest, since he is apprehending his arrest. It is to be noted that on completion of investigation the charge-sheet have been filed against other accused persons and they have been released on regular bail.

On perusal of the charge-sheet, which compile statement of the Ashish Mhaske

2/2 905.doc two victim girls, who were rescued when the raid was conducted on a particular day, both the girls have specifically named the applicant as a person, who had contacted by them and in turn who introduced them to two other co-accused and assured that he will provide work to them. They were taken to a room, where three other girls were residing. They were clearly told that they will be engaging themselves in flesh trade and it is also their specific statement that after the act was completed, the present applicant use to send a Rs. 500/ per customer through the co-accused. The consistency in the statement of the two victim girls definitely warrant the custodial interrogation of the applicant, who is accused of trafficking of women, which is a serious offence. Considering the above the application is rejected.
