1] The Applicant seek following reliefs :

"(a) This Hon'ble Court be pleased to grant No Objection Certificate to the Applicant for re-issue/renewal of Passport and direction to passport authority to re-issue/renew the passport of the applicant for a period of 10 years.

(b) The applicant may kindly be allowed to travel abroad to Sri Lanka for such period and on such terms and conditions as this Hon'ble Court deems fit and proper." 1/2

(11)IA-3091-2023.doc 2] The Application is preferred as the Applicant was convicted by Sessions Case No.255/2012, which has resulted in the Criminal Appeal being filed, which is pending for adjudication before this Court. 3] On hearing the learned counsel for the Applicant and on perusal of the Application, since the Passport of the Applicant has expired, I deem it appropriate to grant request for renewal of Passport, by declaring that the pendency of the Appeal shall not be an impediment in doing so, in case, the Applicant satisfy the other criteria for renewal of Passport.

In the wake of above, prayer clause (a) is made absolute. As far as prayer clause (b) is concerned, since the Application do not furnish any details as to why and when the Applicant intend to travel to Sri Lanka, the Applicant is at liberty to make such request, on furnishing necessary details, after the passport is renewed.
