This is an application received through Jail with a prayer to direct the concerned Court to conduct MCOC Case No.3/2013 arising out of CR No.I-84/2012 registered with Kopri Police Station, Thane pending on the file of Special Court (under MCOC Act) at Thane on day to day basis.

Heard Mr. Toraskar, learned counsel appointed by the Legal Aid Committee and the learned APP.

It is submitted that, the applicant was arrested on 22.8.2012 and since then he is in Jail. It is further Page-1/2

3-appp-784-16 submitted that, till date the Trial Court has not framed charge.

As the applicant is languishing in Jail for more than five years as an under trial prisoner, the learned Judge seized of MCOC Case No.3/2013 is hereby directed to expedite the trial of the said case and to make an endeavour to conclude the same on or before 31.12.2018. 5.

Application is allowed in the aforesaid terms. 6.

The registry is directed to communicate the present order to the applicant who is presently lodged in Aurther Road Jail,Mumbai.
