The learned counsel for the Applicant on instructions submitted that the Applicant and first informant namely Smt. Ashwini Mane have filed an Application bearing HMP No. 128 of 2017 on 11.10.2017 for divorce by mutual consent under Section 13B(2) of the Hindu Marriage Act, 1955 in the Court of learned Civil Judge Senior Division, Malshiras, District - Solapur. In the said Petition, the first informant Smt. Ashwini Mane has agreed to withdraw all the criminal complaints filed by her against the Applicant and his family members. He has produced on record a photocopy of the said Application. 2.

In view thereof, interim relief granted by order dated 06.09.2017 is hereby confirmed. Application is allowed in the aforesaid

ABA 1550-17.doc terms.

It is made clear, that if the statement made by the learned counsel for Applicant as recorded hereinabove is found to be incorrect or contrary to the record, the prosecution and/or the first informant is at liberty to revive the present Application.
