CORAM : B.P. DHARMADHIKARI & SMT. SADHANA S. JADHAV, JJ.

DATE : NOVEMBER 8, 2019.

P.C.:

The matter has remained pending since August, 2014 without any orders. It has been filed with consent for quashing of FIR under sections 354(a), 324, 323, 504, 506 read with section 34 of the Indian Penal Code. The affidavit of complaint giving "no objection" sworn before Notary on 25/8/2014 is filed as annexure with the petition. The complainant has given no objection therein. Consent Terms are also annexed as Exh. C. It appears that accused No.1 (Petitioner No.1) happens to be wife of advocate of complainant. The matter is compromised because of previous acquaintance. 20.wp3774.14.doc In this situation though learned APP is opposing, as we find that nothing fruitful would come out of prosecution, we make rule absolute in terms of prayer clause (a) and dispose of petition.
