The petition was mentioned yesterday for urgent circulation and, therefore, it is kept today.

Praecipe, however, does not disclose that the petition had come up on board on 12 September 2023 and the following order was passed :

" None appears for the Petitioner.

2 The Petitioner has not annexed copy of the original application and has also not given copy of the petition to the office of the Government Pleader. No urgency.

3 Stand over to 23 October 2023".

None had appeared for the Petitioner at that time. Without complying with the order dated 12 September 2023, again circulation is sought. Worse, even after granting circulation, none appears for the Petitioner. The petition is dismissed for want of prosecution.

If the restoration is sought, cost of Rs. 5,000/- be paid to Kirtikar Law Library and the receipt be annexed to the Application and complying with the directions given in the order dated 12 September 2023, the application for restoration, if any, will be considered.
