The Applicants herein have been convicted for the offence punishable under section 138 of the Negotiable Instruments Act. The criminal appeal bearing No.791 of 2012 filed against the order of conviction and sentence has been dismissed vide judgment dated 27th August, 2015. Aggrieved by the said order the Applicants have preferred the revision application in this Court. During the pendency of this revision, the Applicant No.2 has prayed for bail. 2.

Heard the learned counsel for the Applicants. The Respondent No.2 is present in-person. The learned counsel for the Megha 1/2

23_appr_364_15 in revn_418_15 Applicants undertakes to deposit Rs.30,00,000/- before the Sessions Court, Greater Bombay, in C.R. No.17 in three equal installments of Rs.10,00,000/- each within a period of three months from the date of this order. He further undertakes to furnish copy of the receipts to the Respondent No.2 within seven days from the deposit of the amount before the Sessions Court.

Considering the said statement and also considering the nature of the offence the execution of substantive sentence is stayed till the disposal of the revision application subject to the condition that the Applicant No.2 shall furnish bail bond of Rs.15,000/- with one surety in equal amount to the satisfaction of the Sessions Court within a period of 15 days. The Applicants shall also deposit amount of Rs.30,00,000/- in three equal installments of Rs.10,00,000/- each within a period of three months from the date of this order, as undertaken by them and to furnish receipts of such deposits to the Respondent No.2.
