These writ petitions involve a common question and therefore, decided by a common order.

After these petitions were argued for some time, learned counsel for the petitioners, in all fairness, submitted that with a view not to precipitate the matter any further, contends that the petitioner would abide by the order dated 1 October, 2021 passed by the appellate authority. The petitioner undertakes to deposit the interest component with the controlling authority within a period of four weeks from today,

16-wp 284-22 which would enable him to raise all contentions and issues before the appellate authority.

In this view of the matter, learned counsel for the respondent expresses satisfaction and has no objection to the appeal being heard on merits after the deposit is made, in case the deposit of interest is made as stated above within a period of four weeks from today. 4.

If the interest accrued on the date when the gratuity amount was deposited before the controlling authority is deposited within four weeks, then the recovery proceedings initiated by the workmen shall remain stayed.
