--- CORAM : SMT. SADHANA S. JADHAV,J DATE : OCTOBER 18, 2016 P.C.:

Learned Counsel for the applicant submits that the applicant has filed petition under Article 226 of the Constitution of India and Section 482 of the Code of Criminal Procedure, 1973 seeking relief of quashing of FIR. It was also prayed that no coercive action be taken. The learned Counsel for the applicant submits that the Hon'ble Division Bench has been pleased to grant interim relief in the nature of "no coercive action be taken". The applicant is under the umbrella of protection and hence, it would be futile to protect him under section 438 of Code of Criminal Procedure, 1973. Talwalkar 1/2

905.aba1822.16.sxw It is submitted that the orders in the writ petition was passed on 17/10/2016 and the application under section 438 Cr. P.C. was listed for admission today i.e. 18/10/2016 and hence, the applicant had no time to mention the matter. The prayers have become infructuous. The application is disposed of accordingly.
