The learned counsel for the petitioner does not dispute that appropriate statutory remedy of appeal is available for challenging the impugned notice dated 22nd June 2015.

He, however, submits that the against a similar notice issued earlier, an appeal is already filed which is pending. If that be so, the said ground can be agitated in the appeal which may be preferred against the impugned notice. As an efficacious statutory remedy is available to the petitioner, we decline to entertain this petition

wp11009 under Article 226 of the Constitution of India. Writ petition is rejected.

Remedy of the petitioner is kept open.

All contentions of the parties are kept open.
