Learned Counsel appearing for the Petitioners submitted that Petitioners are occupying various positions in the District Judicial Services and were working under the Principal District and Sessions Judge, Nashik. Learned Principal District and Sessions Judge by order dated 26th April, 2016 granted benefits under the scheme "Modified Assured Career Progress Scheme" to certain employees and the Petitioners were deprived of those benefits. It is further submitted by learned Counsel appearing for Petitioners that during the pendency of the Petitions certain identically circumstanced employees were granted benefits by the learned Principal District and Sessions Judge, Nashik and the Petitioners are desirous of

putting their claim before the competent Authority with a prayer to grant similar treatment to the Petitioners as such, the Counsel for Petitioners prayed for withdrawal of the Petitions. Learned Counsel appearing for the Petitioners further submitted that contentions raised in the Petitions may be kept open so that, in case, there is no positive decision in favour of the Petitioners, the Petitioners can avail appropriate legal remedies and disposal of the present Petitions may not come in the way of the Petitioners in future. 3.

Accordingly, at the request of learned Counsel appearing for the Petitioners, the Petitions are allowed to be withdrawn and disposed of as such. The contentions raised in the Petitions are kept open. (SHRIKANT D. KULKARNI, J.) (PRASANNA B. VARALE, J.)
