IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO. 1202 OF 2015 Mr. Nirmal Biharilal Bazaz .. Appellant Vs.

State Bank of India & Anr.

.. Respondents None for the Appellant.

None for the Respondent.

CORAM : K. K. SONAWANE, J.

DATE : 23 rd JULY, 2018.

P. C. :

1.

When the matter is called out, no one else appeared on behalf of appellant. The matter is pending since year 2015. The appellant did not take care to issue notice to the respondents for their appearance into the matter. The appellant moved a Notice of Motion pertains to the property which is the subject matter under the SARFAESI Act. The learned Trial Court rebuffed the relief claimed on behalf of appellant-plaintiff for injunction. The appellant being dissatisfied with the order passed in the month of June, 2015, preferred the present appeal. The appellant did not get the notices of appeal served to the respondents since year 2015. 2.

In view of lackadaisical attitude on the part of appellant, there is no any propriety to keep the appeal alive awaiting presence of the appellant for further process. Hence, appeal stands dismissed for want of prosecution. No order as to costs.
