Heard learned counsel for the parties.

By this Application, the Applicant seeks suspension of his sentence pending the hearing and final disposal of his Appeal. 3.

Perused the papers in particular, the evidence of the prosecutrix - PW.1, her grandmother - PW.2, who lodged the complaint and the evidence of PW.5 - the Medical Officer, who

APPA 1445-18.doc examined the prosecutrix aged 17 years. The prosecutrix has stated about the sexual assault by the Applicant, aged 60 years and the disclosure made by her to her neighbour, who in later informed her grandmother. The evidence of PW.2 is consistent and corroborates the evidence of PW.1. The medical evidence also is consistent with the evidence of the prosecutrix. 4.

Considering the evidence on record, this is not a fit case to enlarge the Applicant on bail. The Application is accordingly rejected.
