After arguing for some time, learned Senior Counsel appearing for the Petitioner submits that challenge to the order dated 21/06/2018 Ex.'A' passed by the District Judge-7, Thane in Civil Miscellaneous Application No.10/2012, may be permitted to be withdrawn with liberty to the Petitioner to Nesarikar

2 / 2 05-WP-10328-18.odt challenge the said order by way of appropriate proceedings. We allow the prayer and grant liberty as aforesaid. 2.

So far as the other prayer made by the Petitioner for deciding its application dated 15/09/2016 Ex.'B' and 02/12/2016 Ex.'C' we direct the third Respondent MIDC to consider and decide the said Applications in accordance with law as expeditiously as possible, after giving due opportunity of hearing to the Petitioner and also to the 'Pfizer Employee's Union'.

The Petitioner and the 'Pfizer Employee's Union' to appear before the competent authority of the third Respondent on 04/10/2018 at 11.00 a.m.

With the aforesaid directions and liberty, the Petition is disposed of.
