By this Civil Application, applicant is seeking condonation of 338 days delay in filing First Appeal challenging the judgment and award dated 12.07.2012 passed by Motor Accident Claim Tribunal in Motor Accident Claim Petition No. 39 of 2008.

Considering the submissions made by learned Counsel for the applicant, averments made in civil application, I am satisfied that the applicant has made out case for allowing this Civil Application. Hence, following order :- S.C.Magar
