Petitioner has challenged the order dated 31.12.2013 passed by the Additional Commissioner, Pune Division, Pune in RTS/Revision/492/2011. The petitioner is having substantive alternate remedy at his command by way of further revision before the State of Maharashtra as held by Apex Court in the case of Gurudassing Nawoosingh Panjwani vs. State of Maharashtra and ors. reported in (2016) 2 SCC 213.

In view thereof, the learned counsel for the petitioner on instructions seeks leave to withdraw the petition with liberty to adopt substantive alternate remedy. 2.

Leave and liberty granted.

Petition is disposed off as withdrawn with the aforesaid liberty.

It is expressly made clear that this Court has not dealt with the merits of the contentions of the parties and all the contentions of the parties are kept open.
