The petitioner has preferred the present petition challenging the order of issuance of process dated 17.12.2014 passed by the learned Metropolitan Magistrate, 39th Court, Vile Parle, Mumbai. The petitioner is having substantive alternate remedy by way of revision before the Sessions Court. In view of the same, the learned counsel for the petitioner on instructions seeks leave to withdraw the petition with liberty to adopt appropriate alternate remedy before the Sessions Court. Leave and liberty granted. Petition is disposed of.
