Having heard the learned Counsel for the applicant and having perused the averments as made in the civil application, it is in the interest of justice that the petition which came to be dismissed for non prosecution, by an order dated 7 December 2018, be restored to the file of this Court. The delay is satisfactorily explained. It is noted that even the respondent did not appear when the said order came to be passed. 2.

Civil Application is accordingly allowed in terms of prayer clause (a) and (b). No costs.
