The only relief sought by way of the above Writ Petition is that Petitioner's tribe claim be directed to be decided by the Respondent No.2 Committee within a particular time frame.

The Petitioner was working with the Municipal Corporation of Greater Mumbai as a Clerk-Rent Collector. The Petitioner has taken voluntary retirement in the year 2017. However, prior thereto the Petitioner's caste certificate was referred to the Respondent No.2 Committee for validation in the year 2013. However, the same is as yet pending consideration. The Petitioner it seems is not receiving pension on account of the fact that the proceedings relating to validity of his caste certificate are pending before the concerned Caste Certificate Scrutiny Committee.

(907) wp-10438.18.doc We therefore direct the Respondent No.2 to decide the tribe claim of the Petitioner expeditiously and not later than 28/02/2019.
