After this Writ Petition was argued for some time we found inadequacy in the pleadings. Under instructions, Mr.Dighe seeks leave to withdraw this Writ Petition with liberty to file a comprehensive Writ Petition which would raised a complete challenge, according to the counsel, to the action of the Municipal Corporation.

In the light of the fact that the petitioner before us has been deprived of his pension for lifetime as a punishment, purely in the facts and circumstances of this case, and not to cause any injustice, we grant leave to withdraw this petition with liberty to file a fresh petition.
