The challenge in the above Petition is to the appointment of the Respondent No.6 as Assistant Vehicle Inspector. The Petitioner herein was also an aspirant for the said post.
Having regard to the provisions of the Administrative Tribunal Act 1985 and considering the fact that the Respondent No.6 is in the services of Union Territory of Dadra and Nagar Haveli, the jurisdiction to challenge the appointment of the Respondent No.6 would be of the Central Administrative Tribunal. It is not possible to accept the contention of the Learned Counsel for the Petitioner that this Court would have jurisdiction since the Petitioner is seeking a writ quo-warranto against the Respondent No.6. We by relegating the Petitioner to the remedy before the Central Administrative Tribunal, mmj
wp-977-17(11).doc dispose of the above Writ Petition. It is clarified that this court has not gone into the merits of the challenge nor the defence of the administration of the Dadra and Nagar Haveli, and it is before the Central Administrative Tribunal that the parties can urge their contentions.
