Mr. Sharad T. Bhosale i/b. Mr. Dilip Bodake for the Petitioner. Mr. Vinayak R. Patil for the Respondent No.5. Mr. A.I.Patel, AGP for the Respondent No.7.
CORAM : A.S. OKA & SMT. VIBHA KANKANWADI, J.J.
DATE : 20th JULY, 2017 P.C.
Perused an additional affidavit filed by the 5th respondent dated 19th July 2017. The statements made in the affidavit as well as photographs annexed thereto show that substantial compliance of the order dated 12th November 2011 has been made by the 5th respondent. However, the 5th respondent will have to make further compliance by removing debris of the demolished structure. Though belatedly, a substantial compliance has been made. Hence, there is no reason to take any further action against the respondents under the Contempt of Courts Act 1971. Accordingly, the Contempt Petition is disposed of. (SMT. VIBHA KANKANWADI, J.)
