Heard Ms. Manisha B. Gawde, learned counsel for the petitioner and Mr. Gul K. Achhra, learned counsel for respondent no.1 at length. Rule. Mr. Achhra waives service for respondent no.1. At the request and by consent of the parties, Rule is made returnable forthwith and petition is taken up finally. 2.

The matter was heard at length on 15.6.2016 and is kept today for passing order. The matter was adjourned till today so as to enable Mr Achhra to take instructions as to whether the respondents are agreeable for setting aside the impugned order. 3.

Mr. Achhra submits that by consent, the impugned order may be set aside and Application Exhibit-49 may be restored to the file of the trial Court.

In view thereof, by consent of the parties, the impugned

Application Exhibit-49 is restored to the file of the learned trial Judge and the same shall be disposed of afresh in accordance with law. All contentions of the parties on merits are expressly kept open. Order accordingly.
