By an Order dated 26.09.2017, the applicant was granted interim relief on his furnishing affidavit-cum-undertaking dated 26.09.2017. In the said undertaking, the applicant had undertaken to deposit a sum of Rs.6,00,000/- on or before 05.10.2017 and Rs.5,85,000/- on or before 31.10.2017 in the Registry of this Court. 2.

The learned APP on instructions submitted that the said cheques deposited by the applicant have been dishonored. The Registry has also put a note stating that the first installment deposited by the applicant by way of cheque dated 05.10.2017 has been dishonored and he Aarti Palkar 1/2

13.ABA.1573.17.doc has not deposited the second installment of Rs.5,85,000/-. Thus, it is clear that the applicant has committed breach of the undertaking given to this Court.

It further appears from the record that the applicant has submitted the said undertaking dated 26.09.2017 and the cheques mentioned therein in the Registry of this Court only with a view to procure interim relief in his favour.

In view thereof, interim relief granted by an Order dated 26.09.2017 is hereby vacated and as a consequence thereof, application is dismissed.
