1] By a reasoned Order dated 28th September 2017, the applicant was granted interim relief and was directed to attend the Instigating Officer on stipulated dates, to join the process of investigation.

2] Learned Counsel for the applicant submitted that the applicant had attended the police station and cooperated in the process of investigation. 3] Perused the record of investigation. As noted earlier, the allegation against the applicant is that, without effecting or registering Deed of Cancellatioin of the said agreements, he further conveyed the property in question by way of separate

Prima facie it appears that the applicant is the intermediate purchaser of the flats in dispute. In view thereof, according to me, the custodial interrogation of the applicant for further investigation of the crime is not necessary. 3] In view thereof, interim relief granted by an Order dated 28th September 2017 is hereby confirmed. However, the condition to attend the Investigating Officer is hereby waived.
