This MCA seeks transfer of a matrimonial proceeding, namely, Hindu Marriage Petition No.211/2015, pending before the Principal Judge, Family Court at Solapur to the file of Family Court at Pune. The only ground urged in support of the transfer application is that the Applicant is an indigent person and cannot afford the expenses of travel from Pune, where she resides, to Solapur for every hearing of the petition.

Learned Counsel for the Respondent is agreeable to pay travel expenses of the Applicant for each of her visits to Solapur for attending the hearing of the petition. The travel expenses are quantified at Rs.1000/- per travel. These expenses shall be paid every time by the Respondent in cash to the Applicant. On this express understanding, the MCA is dismissed. It is, however, made clear that if the Respondent defaults in payment of travel expenses, as ordered by this court, on any date, the Applicant will be at liberty to renew her application for transfer by filing a fresh MCA. 1 / 2
