The notice on respondent no.1 is already dispensed with by this court by an order dated 11th February,2020. The notice on respondent no.2 is already served. None appeared for the respondent no.2 when the matter was called out. There is delay of 211 days in filing first appeal. Heard learned counsel for the appellant and have perused the averments made in the civil application. Delay is sufficiently explained in paragraph (4) of the civil application. The reasons recorded therein are accepted. Civil application is accordingly made absolute in terms of prayer clause (a). No order as to costs. 2.
The applicant is directed to remove all office objections, if any, within two weeks from today. If all the office objections are removed and if the first appeal is numbered, place the same on board for admission on 16th March,2020.
