The application filed by the petitioner/plaintiff seeking permission to adduce evidence of Taluka Inspector Land Record has been rejected. The learned Civil Judge Senior Division, Barshi has rejected the application on the ground that Taluka Inspector Land Record has filed his report on record, inspite of opportunities, none of the parties have raised any objection regarding the report of Taluka Inspector Land Record, therefore, there is no merit in the contention of the petitioner that the respondents are denying the report.

The learned Counsel for the petitioner has again sought to raise contention that the defendants are denying the report. This order is not challenged by the defendants. The learned Civil Judge has clearly recorded that since the defendants also are not challenged the report, no need to examine Taluka Inspector Land Record meaning thereby that the report is binding on the parties. 4.

In view of this position, no interference is warranted in the impugned order. Writ Petition is accordingly disposed of. (N. M. Jamdar, J.)
