Heard the learned counsel for the petitioner and the learned AGP for the respondent Nos.1 to 7. The grievance made in this petition is that though appeal is preferred before the Additional Collector, Pune on 14th January 2015 for challenging the order dated 5th January 2015 passed by the Sub Divisional Officer, neither the application for interim relief nor the main appeal is being heard. Considering the limited grievance, we dispose of the petitions by passing the following order: (I) We direct the petitioner to appear before the Additional Collector, Pune on 17th October

wp9898 2015 at 11.00 a.m. The petitioner shall produce an authenticated copy of this order on that date before the Additional Collector, Pune;

(II) The Additional Collector shall take up the application for interim relief for hearing in the pending appeal after issuing notice to the contesting respondents. The application for interim relief shall be decided as expeditiously as possible and in any event on or before 21st November 2015;

(III) We direct that the order dated 5th January 2015 passed by the Sub Divisional Officer, Junnar, Sub Division Manchar, Pune, shall not be executed till 30th November 2015;

(IV) The petition is disposed of on above terms;

(V) All concerned to act upon an authenticated copy of this order.
