Perused the earlier orders. In the order dated 16/06/2015, it was recorded that none appeared for the petitioner. Even in the past, on 08/12/2010, Petition was dismissed as none appeared for the petitioner. By order dated 13/04/2011, Petition was admitted and interim relief granted earlier was confirmed. The matter was thereafter listed before this Court on 08/05/2015. Since none appeared, the matter was ordered to place on 16/06/2015 under the caption 'for dismissal/disposal'.

In the order dated 16/06/2015, it was further recorded that the petitioner has challenged the order dated 01/09/2009 by which the trial Court appointed Court Receiver. It was, therefore, observed that prima facie, Civil Revision Application is not maintainable.

None appears for the petitioner even today. It appears that the petitioner is not interested in pursuing this Petition. Hence, Petition is dismissed in default. Rule is discharged with no order as to costs. If application for restoration is made, the petitioner shall satisfy the maintainability of this Civil Revision Application. (R. G. KETKAR, J.) 2/2
