By order dated 22/8/2019, the applicant was granted interim protection subject to complying with the undertaking given by him in the court in the form of an affidavit which was marked as "X" for identification.

There was some delay in complying with the direction. But the learned APP Mr. Gavand states that as on date entire amount as undertaken to be deposited in the affidavit is deposited. The office noting on the farad reflect that the amount has been deposited. In the wake of the above, custodial interrogation of the applicant is not necessary. In that view of the matter, the order dated 22/8/2019 is made absolute. Talwalkar

The learned Counsel for the complainant states that he desirous of filing an application seeking withdrawal of the amount deposited in this Court. His attention is invited to the order dated 8th April, 2022 passed on Interim Application No. 762 of 2022 filed by the intervenor seeking withdrawal of Rs. 20 Lakhs deposited by the applicant. Regarding that, applicant/accused has deposited the amount without prejudice to his rights and contentions. There was no undertaking to pay amount the amount to the intervenor nor any such order was passed and the said application came to be rejected. The complainant should be conscious about this order when he moves any further application.
