By this Civil Application, the applicant/insurance company seeks stay to the execution and implementation of the impugned judgment and award dated 3rd May, 2017 passed by the learned Member, Motor Accident Claims Tribunal, Mumbai in M.A.C.P. No. 309 of 2015.

The learned Counsel for the applicant submitted that the applicant/insurance company has already deposited the entire decretal amount alongwith interest accrued thereon. 1 / 2

In view of the above, the impugned judgment and award is stayed till the admission of the Appeal. The statutory amount of Rs.25,000/- deposited in this Court at the time of filing of appeal shall be transferred to the Motor Accident Claims Tribunal, Mumbai. 5.

Civil Application is allowed and is disposed of accordingly. 6.

Place the First Appeal for admission on 14th February, 2018. Parties to take note that the Appeal will be heard finally at the stage of admission.
