There is challenge to the judgment dated 31st August 2017 passed in Regular Civil Appeal No.426 of 2016 delivered by the Court of District Judge, Nashik. By the said judgment the District Court has dismissed the First Appeal filed by the Appellant.

It is submitted that the temporary structure in respect of which the civil proceedings were initiated before the trial Court was removed by the Nashik Municipal Corporation and now the Petitioner does not want to prosecute the Writ Petition as well as present Civil Application, which is for amendment to the Writ Petition. This submission is made on instructions from the Applicant/Petitioner.

In view of that the Civil Application as well as the Writ Petition are disposed of as not pressed.
