This is the second bail application preferred by the applicant, seeking his enlargement on bail in connection with C.R. No. I-83 of 2018 registered with the Uttan Sagari Police Station, Thane, for the alleged offences punishable under Sections 376, 377, 324 and 506 of the Indian Penal Code.

7-BA-3776-2021.doc After arguing for sometime, when the Court was not inclined to enlarge the applicant on bail, learned counsel for the applicant sought leave to withdraw the application.

It appears that the applicant is in custody since 2018, for about 41⁄2 years and till date, charge has not been framed in the said case. Considering the same, the trial of the applicant is expedited. The learned Judge to conclude the trial as expeditiously as possible and in any event, within 6 months from the date of receipt of this order. The prosecution to keep its witnesses present on the dates given by the trial court. The accused also to be produced before the learned Judge inperson or through video-conferencing, as may be directed by the trial Court. The application is dismissed as withdrawn with the aforesaid directions.

Registry to forthwith communicate the above order to the learned Judge seized of the case, either by fax or through a Special Messenger.
