Taking note of the absence of the Appellant, by order dated 13 February 2017, the Appeal was adjourned by way of last chance. 2.

Even today the learned counsel for the Appellant is not present in the Court for argument and request is made on his behalf. The learned advocate was asked to explain the basic facts. He stated he does not even have papers. Such total indifference cannot be countenanced. Second Appeal is dismissed for non-prosecution. 3.

In view of the above, the Civil Application also stands dismissed.
