The Mediator has submitted a final Mediation Report dated 12.10.2017. He has informed that the mediation could not succeed as parties failed to reach amicable settlement.

The undertakings given by the mother-in-law i.e. respondent no.1 and the husband i.e. respondent no.2 in respect of Bandra flat are taken on record and marked as Exhibits 1 and 2 for identification.

In view of these undertakings, the Appeal from Order is disposed of with following order:

ORDER

(i) The appellant shall vacate and shift herself on or before 06.11.2017 in the premises at Flat No. 2635, Building No. 58, Ravi Kiran Co-operative Housing Society, Bandra (East), Mumbai.

(ii) The maintenance and other charges of Bandra flat are to be paid by respondent no.2 i.e. husband and respondent no.1 i.e. the mother-in-law, as they have share in the said flat.

(iii) Respondent no.2-husband shall pay the expenses of school bus of younger daughter of the appellant and respondent no.2.

Appeal from Order is disposed of accordingly.

In view of disposal of Appeal from Order, nothing survives in Civil Application and the same also stands disposed of. (MRIDULA BHATKAR, J.)
