The applicant is apprehending arrest in CR No.511/2017 dated 19.8.2017 registered with Sadar Bazar Police Station, District Solapur under Sections 417 and 420 of the Indian Penal Code.

The report is lodged by Mr. Siddharam Srimant Koli alleging that the present applicant under the pretext of giving him employment in Zilla Parishad School at Solapur took Rs. 7,00,000/- from him. That the applicant did not comply with his promise by giving employment in the said Zilla Parishad school and also refused to repay the said amount. It is categorically stated in the first information report that at the time of handing over Rs.5,00,000/- on 2.7.2015 the brother of the first informant namely Shivanand has recorded Video Shooting of the said transaction. The record prima facie indicates complicity of the applicant in the present crime. The investigation of the present crime is at nascent stage and unless and until the applicant is custodially interrogated, the

1/2 ABA-1581-17-904 entire truth behind the crime cannot be unearthed. It is also necessary for the prosecution to investigate that how may other such persons have been cheated by the applicant and the amount defalcated by him if any in the said cases. 3.

After taking into consideration the serious allegations against the applicant and the gravity of the offence, this Court is of the considered view that, custodial interrogation of the applicant is imperative.

Application is accordingly rejected.
