As far back on 16.10.2018 it was pointed out by learned counsel for the appellant that the suit is dismissed for

Pradnya Bhogale 2 226 AO 534-07.doc default. It is further pointed out that the application for restoration of the suit is filed. The same position is continued as on today.

In this view of the matter, as the Suit is dismissed for default, nothing survives for consideration in the present Appeal and the same is disposed of as infructuous. In the event, the Suit is restored the appellant is granted liberty to apply. 3.

In view of the disposal of the Appeal, all Civil Applications are disposed of.

The Contempt Petition No.382 of 2007, however, will proceed on its own merits.
