This is an application for bail during pendency and final disposal of Criminal Appeal No.931/2022. 2.

The applicant was convicted for the offence punishable under Section 353 of IPC and was sentenced to undergo RI for one year and to pay fine of Rs.3,000/- and in default to suffer RI for three months. This impugned judgment and order is passed by the Additional Sessions Judge, Satara on 24.8.2022 in Sessions Case No.201/2019.

The prosecution case is that on 27.1.2016 at about 3.15 p.m. in the Mamlatdar'

s Court, the applicant behaved arrogantly and manhandled the Peon and the Clerk. He refused to obey the order of the Mamlatdar.

No doubt, the allegations are serious. However, the sentence awarded is only for one year and the appeal is already admitted. The appeal is not likely to be decided within that period. The applicant was on bail during trial. He is also granted bail post his conviction under Section 389(3) of Cr.P.C.. There are no allegations that he has misused that liberty and, therefore, the applicant can be granted bail pending final disposal of the appeal. Hence, the following order :

:: O R D E R ::

i. During pendency and final disposal of Criminal Appeal No.931/2022, the applicant is directed to be released on bail on his furnishing P.R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount. ii.
