After arguing for some time, when I expressed my disinclination to grant relief on merits, learned counsel for the Applicant prays for unconditional withdrawal of the application on merits of the matter. I have considered these submission. The application is allowed to be withdrawn unconditionally, as far as the merits is concerned. However, the Jail Superintendent is directed to give a copy of the latest medical report of the Applicant to the Applicant. The Applicant is at liberty to prefer fresh application only on medical grounds before the trial Court. 3.
If such application is made, it shall be decided by the trial Court in accordance with law on its merits looking at the facts of the case as well as medical condition of the Applicant. 4.
The application is disposed of as such.
