Applicants are seeking pre-arrest bail in Crime No.819 of 2021 registered with Malad Police Station, Mumbai for the offence punishable under Sections 353, 352, 323, 504, 504 r/w 34 of IPC. 2.
As far as the applicant No.1 is concerned, she appears to be mother of applicant No.2.

Learned APP on instructions submits that they are not pressing custody of applicant No.1. However, the applicant No.1 be directed to attend the police station so as to co-operate in investigation.

As this Court is not inclined to grant prayer of applicant BGP.

Application of applicant No.2 - Shivani Deepak Kedia stands rejected as withdrawn.

As far as the applicant No.1 - Laxmi Deepak Kedia is concerned, in view of suggestions made by learned APP, she is directed to attend the investigating officer from 25th November, 2021 to 29th November, 2021 between 10.00 a.m. to 12.00 noon and thereafter as and when directed.

Statement made by Mr. Aabad Ponda that applicant No.2 shall be surrendered on 29th November, 2021 is accepted as an undertaking to this Court.

In view of above, learned Magistrate shall deal with the prayer of bail without being influenced by the withdrawal of the bail application.
