The Petitioner is challenging the measures taken under Section 13 of the SARFAESI Act. The auction sale is scheduled to be held on 26th August, 2019 at 12:30 p.m., the advertisement of which was issued on 23rd July, 2019. Inasmuch as the Petitioner has remedy before the DRT, we are not inclined to entertain the Petition.

The Writ Petition is dismissed with liberty to the Petitioner to approach the DRT.
