DATE: DECEMBER 01, 2021 P.C.:- 1] Heard learned APP, the complainant through learned APP and also the Investigating Officer.
2] Applicant is seeking regular bail in C.R. No.388 of 2021 registered with Cuffe Parade Police Station for the offence punishable under Section 354A of the IPC read with Sections 8 & 12 of the POCSO Act.
3] The maximum punishment prescribed for the offence alleged against the Applicant is five years.
4] Complainant through learned APP informs that if the Applicant is directed to be released she has no objection, provided he should be 1/2
51 BA 3775-21.doc kept away from the jurisdiction of the concerned Police Station. 5] Having regard to the punishment prescribed and that the investigation in the matter is already over, in my opinion, Applicant deserves to be released on bail.
6] Applicant is directed to be released on bail in C.R. No.388 of 2021 registered with Cuffe Parade Police Station for the offence punishable under Section 354A of the IPC read with Sections 8 & 12 of the POCSO Act, on executing P.R. Bond in the sum of Rs 15,000/- with one or more sureties in the like amount. Applicant shall neither directly or indirectly try to influence the prosecution witnesses nor tamper with the evidence. Applicant also shall not try to establish contact with the victim or her family members and he shall also not enter the jurisdiction of the concerned Police Station till the charge is framed.
