1 Heard learned Counsel for the parties.

2 The Learned Counsel for the Applicant submits that, by this Civil Application, they are seeking direction against Assistant Charity Commissioner to forthwith conduct the election of the Trust viz. Gurukul Education Society, Satara after preparing the voters list and determining the objections in voters list.

3. The Learned Counsel for the Applicant submits that, the Trustee Mr. Anand Madhav Gurav is present in the Court. Mr. Anand submits that, elections are over on Laxmi 1/2

51 CAF 4781-13.doc 16/06/2018 and newly elected body is incharge of the Trust. He submits that, they have already filed changed report in the office of the Assistant Charity Commissioner, Satara and the same is pending for hearing and final disposal on its own merits.

4. The Learned Counsel for the Applicant submits that, he has received instructions from his client to withdraw the present Civil Application because nothing survives in the same. To that effect he has given in writing and the same is taken on record and marked as '

X' for identification. The same is accepted.

5. The Learned Counsel for the Respondent No.1 vehemently opposed the statement made by the Learned Counsel for the Applicant about election.

6. Hence, the following order:

a. Civil Application stands disposed of as withdrawn.

b. No order as to costs.
