In my view, having regard to the reasons mentioned in the order, the order passed by the Trial Court rejecting the application for issuing witness summons cannot be found fault with. Hence no case for interference is made out, the Writ Petition is accordingly dismissed. The Learned Counsel for the Petitioner states that the Petitioner would make an application under the Right to Information Act, seeking the documents in question from the Respondent No.3.

However, it would be open for the Petitioner to file an appropriate application if in the event under the Right to Information Act, the documents sought are not made available by the Bank for some reason or the other. [R.M.SAVANT, J] mmj
