This is an application for intervention in Bail Application No. 855 of 2016 in C.R. No. 356 of 2015 registered with Dadar Police Station, Mumbai under section 420 read with section 34 of the Indian Penal Code. The applicant is not the first informant/complainant. The applicant is a witness and under the law it is for the said witness to record her statement before the police if she desires. The learned APP is appointed to represent the State of Maharashtra and to assist the Court in reaching to the appropriate conclusion. The application is misconceived and is accordingly dismissed in limine.
