Versus
The State of Maharashtra .. Respondent --- None for the applicant.
Mrs.S.V.Gajare, APP for the Respondent State. --- CORAM : ABHAY M. THIPSAY, J.
DATED : 7th AUGUST, 2015 --- P.C. :
None present for the applicant when called out. Since the application has been received from prison, an Advocate to prosecute the application was appointed under the Free Legal Aid Scheme. However, such appointed Advocate has been remaining absent continuously.
Under the circumstances, the application is being decided after going through the original bail order, the Record and Proceedings of the Bail Application and the present application. Inspite of the fact that bail was granted to the applicant on 23rd July 2014, the applicant continues to remain in custody. This
Tilak 2/2 (906)APPP-648-14 indicates that the applicant is not able to furnish the bail in the amount stipulated. In the circumstances, I am inclined to reduce the amount of bail.
The bail amount is reduced to Rs.1,00,000/- (Rupees One lakh).
The applicant is given an option to furnish two sureties in the sum of Rs.50,000/- each.
The other conditions imposed by the order granting bail, shall remain unaffected.
Application is disposed of accordingly.
A copy of this order be furnished to the applicant in prison. The prison authorities shall serve the same upon the applicant and report compliance to this Court. (ABHAY M.THIPSAY, J)
